Determining an item’s export control jurisdiction and classification is of critical importance. Jurisdiction determines which export control laws apply to the item, such as the International Traffic in Arms Regulations (ITAR) or Export Administration Regulations (EAR). Classification determines how the item is controlled under the ITAR and EAR, which can affect the licensing requirements, availability of license exemptions/exceptions, and applicable licensing policy. As many enforcement actions have made clear, an incorrect jurisdiction and classification self-determination can lead to a cascade of export control violations and other issues.

This webinar will provide practical and strategic considerations for how to approach jurisdiction and classification assessments, whether that concerns hardware items or intangibles such as information and software. The webinar will then dive into how to document and store these assessments before moving into discussing more advanced jurisdiction and classification issues. Finally, while the regulatory agencies strongly encourage self-determinations, the webinar will discuss options for seeking an official government determination, such as through the ITAR’s commodity jurisdiction procedure or through the EAR’s commodity classification (CCATS) process.

Christopher Stagg will share his considerable experience on jurisdiction and classification matters. He is a former export controls regulator at the Directorate of Defense Trade Controls (DDTC), where he was deeply involved in revising the U.S. Munitions List and Commerce Control List, and he has advised hundreds of companies on resolving complex jurisdiction, classification, and interpretation issues. Christopher recently led the jurisdiction and classification review for a publicly traded company under a consent agreement, with the methodology approved by DDTC without any changes. He also has the rare experience of successfully litigating regulatory interpretation issues affecting jurisdiction and classification.
